SCHOOL DISTRICTS REQUIRD TO ADOPT RETURN TO PLAY POLICY FOR 2011-2012 SCHOOL YEAR

 


On July 28, 2011, Governor Quinn signed the Protecting Our Student Athletes Act (the "Act"), which amends the Illinois School Code by adding a new provision (105 ILCS 5/10-20.53) requiring school districts to adopt a policy pertaining to student athletes return-to-play after suffering a concussion or head injury. P.A. 97-0204.  Specifically, the concussion and head injury policy must comply with the Illinois High School Association's ("IHSA") protocols, policies and by-laws concerning concussions/head injuries. School districts are required to include information concerning the policy in their athletic codes and/or other documents student athletes or their parents are required to sign as a condition of participation in a sport or activity.

Finally, the Act requires all school districts to educate their coaches, student athletes and their parents/guardians of the nature and risk of concussions and head injuries, including the danger of continuing to play after suffering a concussion or head injury. The Act was effective July 28, 2011, which means that all school districts must immediately comply with the above requirements.
